THE TRUSTEES SHALL APPLY NOT EXCEEDING 7 PER CENT OF THE CLEAR INCOME OF THE CHARITY FOR THE RELIEF IN NEED FOR RELIEF IN NEED FOR THE BENEFIT OF THE ELDERLY RESIDENTS IN THE FORMER ANCIENT PARISH OF ST JAMES, WESTMINSTER. IF IN SO FAR AS THE CLEAR YEARLY INCOME OF THE CHARITY IS NOT REQUIRED FOR BY THE TRUSTEES THEREOF IN ACCORDANCE WITH SUB-CLAUSE (2) ABOVE, THE TRUSTEES MAY APPLY THE SAID PROVISIONS FOR THE BENEFIT OF PERSONS WHO BY REASON OF YOUTH OR AGE OR SICKNESS OR INFIRMITY OR DISABLEMENT OR POVERTY OR SOCIAL OR ECONOMIC CIRCUMSTANCES ARE IN NEED OF ASSISTANCE AND WHO ARE RESIDING OR CARRYING ON BUSINESS OR WORKING OR BEING EMPLOYED OR EDUCATED ELSEWHERE IN THE AREA COMPRISING THE LONDON BOROUGH OF THE CITY OF WESTMINSTER (AS CONSTITUTED BY THE LONDON GOVERNMENT ACT 1963) OR WHO FOR A PERIOD OF NOT LESS THAN 5 YEARS HAVE RESIDED OR CARRIED ON BUSINESS OR WORKED OR BEEN EMPLOYED IN THE SAID LONDON BOROUGH AND IF THE TRUSTEES THINK FIT SHALL INCLUDE HOMELESS PERSONS FOUND WITHIN THE SAID LONDON BOROUGH.
